NYT also had an article today in which Judge Sotomayor basically explains what we’ve been talking about around the blogs for a couple of weeks – that life experience as a woman or a member of a minority group is in itself a qualification.
I don’t care what her other qualifications are, she’s bad on the first amendment, bad on the fourth amendment, and thinks its perfectly OK to admit hearsay for a 115 month “sentence enhancement.” All she needs is a pro-life pedigree and she’d practically be another Scalia.
Well….here we go. I didn’t look at her too closely beforehand, where is she bad on the first & fourth amendments?
As for her being pro-life…she is Catholic, it isn’t out of the realm of possibility. Whether it effects her legal decisions is a different matter.
She’s not always bad on the First Amendment; sometimes she’s quite good. I think William is referring to a case where Sotomayor’s 2nd Circuit panel held that a public school did not violate a student’s First Amendment rights when they suspended her for inappropriate comments she made on her LiveJournal (or some other website). It was a bad decision, but not her only one.
